Terms & Conditions

TerraNetwork provides web hosting for an agreed annual fee. Customers can use their hosting account for business or personal use and content. The minimum age requirement for the person purchasing, and/or using, our hosting services is 18 years.

TerraNetwork reserves the right to suspend or cancel a customers access to any or all services if the account has been inappropriately used.

Server use

Personal accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owners web site. Exceptions to this include ad banners, classified ads, and personal ads.

Reseller accounts can be used to sell hosting up to the allowed limits of the hosting account (number of sites, number of emails, bandwidth and web space).

TerraNetwork reserves the right to refuse service and /or access to its servers to anyone.

Scripting and Banned Scripts:

You can use any script on our servers as long as these scripts do not interfere with operating the server and are not one of the following:

  • Cgi-based message forums, auctions and banner exchanges are known to disrupt server operations and if this is the case, then TerraNetwork reserves the right to suspend the hosting account until the problem has been resolved
  • Chat scripts are strictly prohibited and must not be used on any of our shared servers
  • Formmail is not allowed on any of our servers. You are only allowed to use formmail scripts if they are up to date, secure and not running under the filename "formmail". Any violation of this condition will result in the script being deleted without notice.
  • If you are using a 3rd party software, for example Zen Cart, osCommerce, Joomla etc. then you must keep the script up to date. If you buy a template, for example from Template Monster, then it is your responsibility to ensure that the software is updated to the latest release.

Contact Forms (Sendmail)

Site owners operating any kind of "contact us" form which generates emails must keep their forms secure and up to date. Scripts which have been exploited or are found to pose a security threat will be disabled and continued use of insecure scripts will lead to suspension of the hosting account. This is necessary as insecure forms are a major source of sending out spam and can get an entire server IP blacklisted by email providers.

To keep your site secure:

  • If your software contains a contact form, for example Zen Cart, osCommerce, Joomla etc., then you must keep the software up to date.
  • Do not write your own contact forms unless you have sound experience in stopping exploits, and if you commission a developer ensure that security measures are implemented.

Spam (unsolicited mass mailing)

TerraNetwork does not allow any account holder to engage in spamming of other web users. This applies even if the spammer uses e-mail facilities outside of their website, but pursues spamming on behalf of their website. The sending of e-mails for the purpose of sending abusive material is also strictly prohibited.

A message is considered unsolicited if the recipient has not explicitly requested to receive messages from your site. If a site is found to be an alleged source of spam then we will investigate the claim. Any site found to have sent out unsolicited mass mailings will be suspended and may result in cancellation of the hosting account without refund. TerraNetwork reserves the right to determine what constitutes a violation of our policy.

Site owners are requested to follow the following guidelines:

  • not to email all customers with marketing material unless they specifically subscribed to a newsletter.
  • not to use the "email all customers" function in osCommerce. Only customers who subscribed to your newsletter can be legally mailed.
  • not to use mailing lists purchased from 3rd party providers. These will often be illegally harvested email addresses, but even in other cases may draw complaints of spamming.

Content and Links prohibited on our serves

TerraNetwork does not allow any of the following content to be stored on its servers:

  • Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any UK regulation.
  • Pornographic Material - TerraNetwork does not allow adult web hosting. Specifically, this includes the depiction of any act of sexual intercourse, exposure of the male or female genitalia, and the depiction of minors in any way which can be construed as having a sexual theme/content. The designation of 'adult' or 'pornographic material' is left entirely to the discretion of TerraNetwork.
  • Adult Webmasters - If you wish to set up an 'Adult' website we are afraid we cannot host your site on our servers. If you are in doubt as to what qualifies as being 'Adult' please contact us before purchasing an account with us.
  • Abusive Material - TerraNetwork does not allow on its servers any content which is, in any way, racist, sexist, homophobic, or which seeks to denigrate in any manner any ethnic or other social group.
  • Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Credit/Debit Card Details

TerraNetwork prohibits the storing of credit/debit card details on our servers. We also prohibit the transmission of credit/debit card details by email via our servers. TerraNetwork reserves the right to suspend sites found in breach of this policy.

The storing of the last 4 digits of card numbers and the expiry date is allowed. All sites are allowed to use 3rd party payment processors as long as the data is transmitted securely (128 bit encryption) and not stored on our server or sent by email.

Background-running Programs

Background-running programs are prohibited on our servers including any IRCS related software (e.g. bouncers and bots). Customers are not allowed to compile and run software on our servers.

Domain Name Registration

In the first instance you are responsible for making sure that the domain name you wish us to register for you, as part of your package, is available for registration. If, in the period between your domain name checks and our registration of the domain name, the domain name has been taken by someone else, we will advise you of this and then you may choose an alternative domain name (of the same type) for registration by us. Failure to acquire your first choice domain name will not invalidate the hosting agreement between yourself and TerraNetwork.

Bandwidth Use Policy

Each type of account is allocated a bandwidth allowance. If you require a higher bandwidth, or if your bandwidth exceeds that allowance, then additional bandwidth is charged at the following rate - for each extra 1Gb (gigabyte) of Bandwidth per month a charge of £18 per annum. At our discretion you may not be charged for excess bandwidth in the first instance of a over-run of your allowance, but you will be asked to increase your allowance to cover for future eventualities, and failure to do so may invalidate your hosting agreement with us. We will deal with each individual case depending upon its merits. For inexperienced site owners/users, 2 Gbs per month bandwidth means that a web page containing 100Kbs of data may be accessed 20,000+ times each month, or (1/4) a quarter of a million times each year. This is more than enough for most website owners, even for small/medium size business users.

Payment Policies

All accounts are set up on a prepay basis. Although TerraNetwork reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be advised of the impending anniversary of payment, and will be provided with a secure link to PayPal where they may renew their service/s. If the customer fails to renew by the said date, the account will be shut down and all content removed from our servers.

Payment may be made in UK Pounds. Payments will appear on Credit Card statements as payments made to PayPal - TerraNetwork.

No bills or invoices will be sent by regular mail. All invoices will be sent directly to customers via email shortly after the online purchase has been made.

It is important that customers keep their email address on file with us current. Should an email address change you must notify us of your new email address. Failure to do so may mean that important communications and renewal invoices do not reach you and may result in your account being suspended or closed.

Wherever possible we advise customers to use a non-domain based email address as their contact address to ensure that customers can be contacted during repointing and site suspension.

Cancellation and Refund Policy

TerraNetwork reserves the right to cancel the service at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes TerraNetwork's Terms and Conditions of Service a refund will not be issued in the event of a cancellation.

Customers may cancel their account at any time.

Fees charged on a prepay basis are non-refundable.

Indemnification

Customer agrees that it shall defend, indemnify, save and hold TerraNetwork harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against TerraNetwork, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless TerraNetwork against liabilities arising out of:

  1. any injury to person or property caused by any products sold or otherwise distributed in connection with TerraNetworks servers;
  2. any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
  3. copyright infringement and
  4. any defective products sold to customer from TerraNetwork servers.

Acceptance of Terms & Conditions

Opening your account with TerraNetwork will signify your acceptance of these Terms and Conditions.

TerraNetwork reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
